India’s Home Affairs & Health Ministries Divided Over Section 377

[Note: India is up in arms on the whole of Section 377, and not just 377A, as is the case in Singapore.]

During the hearing of a petition to decrimimalise gay sex, the Delhi High Court was presented with contradictory affidavits with the Ministry of Home Affairs favouring the retention of the law and the Health Ministry against its enforcement.

The Unnatural Afterlife of the Section 377A Debate

This Friday, on 23 May 2008, Douglas Sanders will give the lecture that he was not permitted to give last year. He will be speaking at the Asian Law Institute’s annual conference, hosted by the National University of Singapore (NUS). The title of his lecture is “377 – and the unnatural afterlife of British colonialism”, wherein he will map how a law that has long been repealed in the UK, has lingered (and been stoutly defended) in many ex-colonies.

On 377A Again

Just days before Chan’s case came along, I actually came across this pretty insightful posting by Trevvy user jayencee in the threads, and with his blessing, I hereby reproduce it below :)

When 377a was last debated in Parliament, PM Lee gave the last word on the matter by saying that the section was being kept on the books more as a symbolic gesture to placate the more conservative forces in society than for any practical consideration.
